This Privacy Policy explains how Look Sharp Labs, Inc., a Delaware corporation operating from California (together with its affiliates, "TYGER," "we," "our," and "us"), collects, uses, discloses, and protects personal information when you use the website at https://tyger.gg (the "Site"), the TYGER mobile applications, or the services we provide through the Site, the apps, or third party platforms (collectively, the "Service").

This Policy applies to personal information processed by TYGER as a controller. By accessing or using the Service, you acknowledge that you have read and understood this Policy. If you do not agree, please do not use the Service.

Some Service features (for example, the "Post TYGER" feature) let you share music, video, images, and other content publicly. Information you share publicly through these features may be viewed, copied, or collected by other users and third parties, including outside the Service. Only post what you are comfortable making public.

1. Information We Collect

We collect personal information you provide directly, information collected automatically when you use the Service, and information from third parties. The categories below align with the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA").

A. Identifiers

Name, username, email address, account credentials, IP address, device identifiers, advertising identifiers, and similar identifiers. 

B. Customer records

Billing information and payment card information (processed by our payment processors and not stored by TYGER in full). We do not collect telephone numbers or postal addresses as part of customer records.

C. Commercial information

Records of subscriptions, purchases, and Service usage.

D. Internet or other electronic network activity

Browser and device details, operating system, referring URLs, pages and screens viewed, in-app actions, session duration, search queries, interactions with content, and information collected through cookies and similar technologies.

E. Geolocation data

Approximate location derived from IP address. With your permission, more precise device location.

F. Audio, electronic, visual, and similar information

Music, audio, video, photos, voice recordings, and other content you upload, post, or transmit through the Service.

G. Inferences

Profiles and preferences we derive from the categories above to personalize and improve the Service.

H. Sensitive personal information

Account login credentials in combination with passwords. We use sensitive personal information only for the purposes permitted by law, including to provide and secure the Service. You have the right to limit our use and disclosure of sensitive personal information as described under "Your Privacy Rights" below.

Note: We do not knowingly collect Social Security numbers, driver license numbers, financial account numbers other than what is needed to process payments, precise geolocation, racial or ethnic origin, religious or philosophical beliefs, union membership, genetic data, biometric identifiers, health data, or sex life or sexual orientation data.

2. Sources of Personal Information

We collect personal information from the following categories of sources:

  • Directly from you when you create an account, configure your profile, upload content, contact support, or interact with the Service.
  • Automatically through your devices and browsers when you use the Service, including through cookies, SDKs, log files, and first-party analytics tools.
  • From service providers and processors who help us operate the Service, including hosting, first-party analytics, payment processing, identity verification, fraud prevention, and customer support.
  • From social networks and authentication providers when you choose to log in, link an account, or share content.
  • From other users when they interact with you on the Service or refer you.
  • From publicly available sources.

3. How We Use Your Information

We use personal information for the following business and commercial purposes:

  • To provide, operate, maintain, and improve the Service, including account creation, authentication, content delivery, transmission of personal video and audio messages, and customer support.
  • To process payments and administer subscriptions.
  • To personalize content, recommendations, and features.
  • To communicate with you about your account, transactions, security, technical notices, updates, and policy changes.
  • To send marketing communications about TYGER. You can opt out at any time.
  • To present first-party contextual recommendations and partner offers within the Service based on the content you are interacting with rather than a profile of you. We do not disclose your personal information to a partner unless you choose to engage with the offer and consent to the disclosure.
  • To conduct research, analytics, and product development to understand how the Service is used and to improve it.
  • To detect, investigate, and prevent fraud, abuse, security incidents, and violations of our terms.
  • To comply with legal obligations, respond to lawful requests, and enforce our agreements.
  • To facilitate corporate transactions such as a merger, acquisition, financing, reorganization, or sale of all or a portion of our assets.

4. Legal Bases for Processing (EEA, UK, Switzerland)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, we rely on the following legal bases under the General Data Protection Regulation and the UK GDPR:

  • Performance of a contract: to provide the Service you request and fulfill our obligations to you.
  • Legitimate interests: to operate, secure, and improve the Service; to detect and prevent fraud and abuse; to communicate with you about products and services; and to support our business operations, where these interests are not overridden by your rights.
  • Consent: for marketing communications where consent is required, for non-essential cookies, and for processing of any sensitive data with your explicit consent. You may withdraw consent at any time without affecting the lawfulness of prior processing.
  • Legal obligation: to comply with applicable laws and regulatory requirements.
  • Vital interests: in rare cases where processing is necessary to protect a person's life or safety.

5. How We Disclose Personal Information

We disclose personal information to the following categories of recipients:

  • Service providers and processors that perform services on our behalf, such as cloud hosting, content delivery, first-party analytics, payment processing, customer support, communications, fraud prevention, and security. These parties are contractually limited to processing personal information for our specified business purposes and may not use it for their own purposes.
  • Other users and the public when you post, share, or otherwise make information public through Service features.
  • Affiliates and subsidiaries within the TYGER corporate group.
  • Professional advisors such as auditors, lawyers, bankers, and insurers, where reasonably necessary.
  • Government authorities and other parties when required by law, to enforce our agreements, to protect rights and safety, or in connection with legal proceedings.
  • Successors in a corporate transaction, such as a merger, acquisition, financing, reorganization, bankruptcy, receivership, or sale of all or a portion of our assets.

6. No Sale, No Sharing, and No Targeted Advertising

TYGER does not sell your personal information. TYGER does not share your personal information for cross-context behavioral advertising, and we do not engage in targeted advertising as those terms are defined under the California Consumer Privacy Act (as amended by the CPRA), the Virginia Consumer Data Protection Act, the Colorado Privacy Act, the Connecticut Data Privacy Act, the Utah Consumer Privacy Act, and other applicable US state privacy laws. We have not sold or shared personal information for these purposes in the preceding 12 months and have no plans to do so.

How we connect users with relevant goods and services without selling or sharing data:

  • First-party contextual recommendations. Recommendations and offers shown inside the Service are based on the content and context of your current activity (for example, the genre or type of music involved), not on a profile we build about you for advertising and disclose to others.
  • Service-provider relationships. When we use vendors to help operate the Service (hosting, analytics, payment processing, customer support, fraud prevention), they act as our service providers or processors under written contracts that prohibit them from using your personal information for their own purposes, retaining it beyond the scope of the contract, or combining it with data from other sources except as permitted by law.
  • Aggregated and de-identified information. We may use and disclose aggregated or de-identified information that cannot reasonably be used to identify you. We commit to maintain and use such information only in de-identified form and not to attempt to re-identify it.
  • Partner offers. If we present an offer from a third party, we do not disclose your personal information to that partner unless you choose to engage with the offer and consent to the disclosure.

7. Cookies and Similar Technologies

We and our partners use cookies, software development kits (SDKs), pixels, local storage, mobile advertising identifiers, and similar technologies to operate, secure, analyze, and personalize the Service.

8. Data Retention

We retain personal information for as long as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce our agreements. Specific retention periods depend on the type of information and the purpose for which it is processed:

  • Account information: for the life of your account and for a reasonable period after deletion to allow account recovery, fraud prevention, and legal compliance.
  • Content you upload (including audio and video): until you delete it or close your account, subject to backup retention cycles and legal holds.
  • Transaction records: for the period required by tax, accounting, and audit laws (typically up to 7 years in the United States).
  • Marketing data: until you opt out, with suppression list retention to honor your opt-out preference.
  • Server and security logs: typically up to 24 months, unless a longer period is required for an investigation or legal hold.

9. Information Security

We maintain administrative, technical, and physical safeguards designed to protect personal information against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, and unauthorized access. These include encryption in transit, access controls, employee training, vendor due diligence, and monitoring. No method of transmission over the internet or method of electronic storage is fully secure, and we cannot guarantee absolute security.

10. Data Breach Notification

If we discover a security incident affecting your personal information, we will notify affected individuals and applicable regulators in accordance with applicable law, including under the GDPR (within 72 hours of becoming aware where required), the UK GDPR, US state breach notification laws, and other applicable frameworks.

11. International Data Transfers

TYGER is based in the United States. When you use the Service, your personal information may be transferred to, stored in, and processed in the United States and other countries that may have data protection laws different from those in your country of residence.

For transfers of personal information from the European Economic Area, the United Kingdom, or Switzerland to a country that does not benefit from an adequacy decision, we rely on appropriate safeguards, including the European Commission's Standard Contractual Clauses (2021) and, where applicable, the UK International Data Transfer Addendum or the Swiss equivalent. 12. Your Privacy Rights

A. Rights for California residents (CCPA/CPRA)

California residents have the following rights, subject to verification and certain exceptions:

  • Right to know: request the categories and specific pieces of personal information we have collected, the sources, the purposes, and the third parties to whom we disclosed it (over the prior 12 months).
  • Right to delete: request that we delete personal information we collected from you.
  • Right to correct: request that we correct inaccurate personal information.
  • Right to opt out of sale or sharing: TYGER does not sell or share personal information, and there is nothing for you to opt out of with respect to TYGER. You retain this right under California law and we will honor it if our practices ever change.
  • Right to limit use of sensitive personal information: limit our use of sensitive personal information to purposes permitted by law.
  • Right to non-discrimination: not be discriminated against for exercising your rights.
  • Authorized agent: you may designate an authorized agent to make a request on your behalf. We may require verification of the agent's authority and your identity.

California "Shine the Light" (Civil Code section 1798.83): California residents may request information once per year about disclosures of personal information to third parties for direct marketing purposes. Submit requests to contact@tygermedia.ai with the subject line "Shine the Light Request."

B. Rights for residents of other US states

Depending on where you live, you may have similar rights under state privacy laws including those of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Tennessee, Indiana, Delaware, New Hampshire, New Jersey, Maryland, Minnesota, Kentucky, Rhode Island, and others as they take effect. These rights generally include the right to access, correct, delete, port your data, and opt out of targeted advertising, sale of personal data, and certain profiling. To exercise these rights, follow the instructions under "How to Exercise Your Rights" below. If we deny a request, you may have the right to appeal as described in the response.

C. Rights for residents of the EEA, UK, and Switzerland

You have the following rights under the GDPR, the UK GDPR, and the Swiss Federal Act on Data Protection:

  • Right of access to your personal data and to receive a copy.
  • Right to rectification of inaccurate or incomplete data.
  • Right to erasure ("right to be forgotten") in certain circumstances.
  • Right to restriction of processing in certain circumstances.
  • Right to data portability for data you provided to us.
  • Right to object to processing based on our legitimate interests, including direct marketing.
  • Right to withdraw consent where processing is based on consent.
  • Right not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects, except as permitted by law.
  • Right to lodge a complaint with a supervisory authority in your country of residence, work, or where the alleged infringement occurred.

D. How to exercise your rights

To exercise any of these rights, contact us at contact@tygermedia.ai or use the privacy controls available in your account settings. We will verify your request using information associated with your account or other reasonable measures proportionate to the sensitivity of the request. We will respond within the timeframes required by applicable law (generally 45 days under US state laws, with one 45-day extension where permitted, and one month under the GDPR/UK GDPR, extendable by up to two additional months for complex requests).

13. Children's Privacy

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13 in violation of the Children's Online Privacy Protection Act ("COPPA"). If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will delete it promptly. Parents or guardians who believe their child has provided personal information to us may contact us at contact@tygermedia.ai.

Where required by California law, we do not knowingly sell or share personal information of minors under 16 without the affirmative authorization required by law. Where required by other state or international laws, we apply additional protections for minors and obtain consent as required.

14. User-Generated Content and "Post TYGER"

Service features such as "Post TYGER" allow you to share music, audio, video, photos, captions, and other content with other users or the public. Content you share publicly may be viewed, copied, downloaded, redistributed, or used by other users, search engines, and third parties, including in ways that we cannot control. Once content has been shared, we cannot guarantee its removal from third party services or other users' devices. Please consider carefully what you choose to share and your rights to do so. Do not upload content for which you do not hold the necessary rights or permissions.

15. Third-Party Sites and Services

The Service may contain links to or integrations with third-party websites, apps, or services. We are not responsible for the privacy practices of those third parties. We encourage you to review their privacy policies before providing any personal information to them.

16. Business Transactions

If TYGER is involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your personal information may be transferred as part of that transaction. We will provide notice and obtain consent where required by applicable law.

17. Automated Decision-Making and Profiling

We may use automated systems to personalize content, prevent fraud, secure the Service, and analyze usage. These systems do not produce legal or similarly significant effects on you. Where automated decision-making with significant effects is used, we will inform you and provide the rights required by applicable law.

18. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the most recent revision. Material changes will be communicated through the Service or by other reasonable means before they take effect. Your continued use of the Service after the effective date of the revised Policy constitutes acceptance, except where additional consent is required by law.
